Option for APA Hearing

In order to assure compliance with the Iowa Administrative Procedure Act, Chapter 17A of the Iowa Code, in major cases, ISU provides the option for students or student/campus organizations to have their case heard by an administrative law judge under the procedures of Iowa Code §17A.11-16 and 681 IAC 20. Students will be advised of this right in the Formal Complaint. Students or student/campus organizations must make the election within five business days of receiving the Formal Complaint. Otherwise, they are deemed to have waived their right to an APA Hearing.

In APA hearings, the University may elect to have a member of its legal staff present the case to the administrative law judge.
